MODEL CONSTITUTION IN RESPECT OF RESIDENTS WELFARE ASSOCIATIONS RECOGNISED BY THE GOVERNMENT OF INDIA DEPARTMENT OF PERSONNEL & TRAINING

All welfare Associations of the Central Government Employees in receipt of grants-in-aid from the Department of Personnel & Training, New Delhi shall be required to be registered under the Societies Registration Act, 1860.

2. According to the Act, any seven or more persons having intention to form a Society may, by subscribing their names to a Memorandum of Association form themselves into a Society under the Act. In case of Welfare Association, however, an Association of not less than 200 Government Servants ( unless otherwise justified as a special case) shall be registered.

3. The Act lays down that the ‘Memorandum of Association ‘ and the ‘ Rules and Regulations’ of any Society/Associations should be drawn up separately. Further, that whereas the ‘Memorandum of Association’ should contain the names of the Society, the names, addresses and occupations of the members of the governing body etc., the ‘Rules and Regulations’ should have the details of the Constitution like membership, manner of holding meetings, powers of the functionaries etc., the page-numbering of the rules and their classification/numbering are also required to be done separately from the Memorandum.

4. The Memorandum of Association shall contain the following provisions :-

(i) THE NAME OF THE ASSOCIATION

No distinction of class or character should appear in the name of Association(s). It is advisable to name an Association as ‘ CENTRAL GOVERNMENT EMPLOYEES RESIDENTS WELFARE ASSOCIATION / KENDRIYA SARAKARI KARAMCHARI AWASIYA SUDHAR KALYAN SABHA’ ______________________________followed by the name of Blocks/Type/Number of Quarters/area covered or represented by the Association so as to suitably give an identification to it. No names other than the two mentioned above will be acceptable and, for the sake of uniformity, such Associations having different names should initiate action to change their names. An intimation to this effect will be sent to the Department of Personnel and Training.

(ii) THE ADDRESS OF THE REGISTERED OFFICE OF THE ASSOCIATION

This should be the Home Address of the SECRETARY of the Association/Sabha/Samiti authorised to correspond with the Government or local Authorities etc. The name of the sender of the communication may be typed, if necessary.

(iii) THE JURISDICTION OR THE AREA OF OPERATION OF ASSOCIATION

This shall state in un-ambiguous terms the jurisdiction of the Association in which it shall function. There should be a specific mention of the name of Blocks e.g., Block ‘A’, ‘B’, ‘C’ of ——— or the types of Qrs/Blocks (e.g. 500 Qrs from No.______ to No._______ ), the residents of which shall be entitled to become members of the Association. The area of operation should be a compact one, that is to say, it should not be fragmented/disjointed or scattered. Another important point is that it should not encroach upon or overlap the jurisdiction of another Association in the vicinity recognised by the Department of Personnel & Training.

(iv) THE OBJECTS FOR WHICH THE ASSOCIATION IS ESTABLISHED

(a) To foster a spirit of mutual help and goodwill among the inhabitants of the colony in general, and the members of the Association in particular, thereby, promoting communal harmony and national integration.

(b) To make all possible efforts to achieve general amenities, Consumer protection such as interaction with traders on quality and quantity of goods, over charging etc. monitoring of the public distribution system including supply of essential and consumable items and environmental protection such as steps to curb pollution, ensure cleanliness, plantation of trees, interaction with authorities on any environmental aspects and for this purpose, represent the interest of the residents before appropriate authorities.

(c) To undertake all such other lawful acts, deeds or things including Sports and Cultural activities as are incidental or conducive to the attainment of any or all of the above objects including the general Welfare of the Employees and their families.

(d) To promote such welfare and socio-economic activities as may be approved by the Departments of Personnel & Training.

(v) The Managing Committee will set targets in the areas stated in the objects and conduct half-yearly reviews to assess the achievements of targets. This will be called the Annual Action Plan of the Association. A copy of the Action Plan has to be sent to the Chief Welfare Officer, Departments of Personnel & Training in the beginning of the Financial year. The Association, while applying for grants-in-aid to the Department of Personnel & Training, shall indicate, with special reference to the Action Plan, achievements or shortfalls with reasons.

5. The Association shall, however, desist/refrain from taking part directly or indirectly in any political or anti-government activities or associating with foreigners or foreign Institution/Association. The Association shall not bring any political or other outside influence to bear upon any authority in connection with the affairs there of.

6. The ‘Memorandum’ of the Association should, further, give the names, address, occupations and designations of the members of the governing body ( at the time of registration) to whom the management and affairs of the Association have been entrusted. It is also required to be duly signed by these members before it is registered.

7. The ‘RULES AND REGULATIONS’ of the Association shall contain the following provisions :

RULES AND REGULATIONS

I. OFFICIAL YEAR

The official year shall be the financial year i.e., from 1st April to 31st March.

II. MEMBERSHIP

(a) There shall be two types of members :

(1) REGULAR

Central Government employees and employees of Delhi Administration, shall qualify for ‘ Regular’ membership of an Association in receipt of the grants-in-aid from the Department of Personnel & Training, subject to fulfilment of conditions as laid down in para (b) to (g) below.

(2) ASSOCIATE

Employees of the following offices shall, however, be eligible for enrolment as ‘Associate’ member only :-

(i) Attached and Subordinate offices of the Railway Board.

(ii) Subordinate offices of the Director general, Posts and Telegraphs

(iii) Retired Central Government servants

(iv) Members of the Armed Forces and other Armed forces of the Union

(b) There should be a drive to maximise membership. For this purpose, as many persons, who fulfill the eligibility conditions for membership are to be so enrolled on the payment of the fee prescribed by the General Body of the Association. No person, who is eligible to become a member and who is willing to pay the prescribed fee, shall be denied membership.

(c) The following ‘ Regular’ members will be eligible to seek office in the Managing/Executive Committee:

(i) Who are allottees of the Government Quarters in the area and are residing there;

(ii) Who are residing in the colony on sharing basis after obtaining official approval; and

(iii) Husband/wife, sons and daughters of a Government servant, who are also Central Government employees and residing in the same flat, provided no other regular member from the same house is/are contesting for any office in the Managing/Executive Committee.

(d) Associate member as mentioned in 2(1) to (iv) above who are allottees and residing in the area or are residing on sharing basis after obtaining official approval shall not be eligible to seek office in the Managing /Executive Committee, though they shall have the right to vote in elections.

(e) While enrolling as member or renewing membership, the Association has to satisfy itself that the individual who is being enrolled falls in any of the categories mentioned above. The sample of this is at Annexure-I

(f) In case, any Central Government employee, eligible to become a member of the Association of the area where he resides, faces any difficulty in becoming the member of the Association, he/she can submit an application direct to the Area Welfare Officer for necessary action who will settle the matter, if necessary, in consultation with the Chief Welfare Officer, Department of Personnel & Training.

NOTE: Membership shall not be open to the employees of the private shops/companies, Banks, Autonomous Bodies, Public Sector Undertakings, New Delhi Municipal Committee, Municipal Corporation of Delhi and Bodies created by or under any specific Act of Parliament.

III ADMISSION FEE & SUBSCRIPTION

(a) Every person admitted as member shall have to pay an admission fee at the time of enrolment and also subscription (monthly/quarterly/annually) as laid down by the Association in their Constitution, in advance. Proper receipts will be issued to the members in token of having received the enrolment fee and the subscription. The signatures of the members shall be obtained on the office copy/counterfoil of the receipt book in token of his having received the receipt. The membership shall cease automatically if the same is not renewed within one month of the beginning of the next official year. In such cases, membership can be revived only after payment of all arrears on account of subscription or other dues outstanding against the member plus a nominal fine as may be prescribed by the Managing Committee.

(b) The Managing Committee shall have the right to raise funds as and when necessary and charge additional subscription from members for any individual games, events, activity or function of the Association.

IV.MANAGEMENT

(a) the affairs of the Association shall be managed by a Managing Committee consisting of the following office-bearers :-

(i) President – (One post)

(ii) Vice-President – (One post)

(iii) Secretary – (One post)

(iv) Joint Secretary – (One Post)

(v) Treasurer – (One Post)

(vi) Convenor (Civic amenities & Health – (One Post)

Services)

(vii) Convenor (Sports & Cultural – (One Post)

Activities)

(viii) Convenor (Environment & – (One Post)

Consumer Rights and Security)

(ix) Members – (Two Posts)

(b) All the above members of the Managing Committee will be elected simultaneously

(c) The office-bearers and members of the Managing Committee shall hold office for two years. However, they shall continue until fresh elections are held and results declared by the 30th of April, of that year whichever is earlier.

Note: Those persons who are due to retire within this period would not be eligible to contest the election.

(d) No office-bearers i.e., President, Vice-President, Secretary and Treasurer shall hold any of these office for more than two terms continuously (Block years) i.e., for a period of 4(four) years. He/She may continue in the Managing Committee in any other capacity. A member of the Managing Committee may, however, seek office after a lapse of one term(two years) to any of the above mentioned FOUR posts. The contestants for Treasurer post should preferably have the knowledge of accounting procedure.

(e) The committee shall meet once a month. A notice of 3 (three) days shall be necessary to call an ordinary meeting whereas no notice shall be necessary for an emergent meeting.

(f) The quorum for ordinary meetings of the Managing Committee shall be 1/3rd of the total membership thereof whereas no quorum shall be necessary for an emergent meeting. Any member who does not attend three meetings of the Managing Committee consecutively without permission ( from the President or the Vice-President in the case of President himself ) shall be removed from the Managing Committee and would be informed in writing. Such action of the Managing Committee would be got ratified by the General Body.

(g) Every member present and voting in the Managing Committee shall have one vote provided in the case of equal division of votes, the President shall have casting vote.

(h) The committee shall be responsible for the day-to-day management of the affairs of the Association and shall have the power to incur expenditure within the funds available with the Association for conducting the activities of the Association. It shall not go in debts or take loans for conducting its activities.

(i) The Managing Committee shall, at the appropriate time, in consultation with and after the approval of the Area Welfare Officer, appoint a RETURNING OFFICER from among the members of the Association for holding the annual elections, provided that such member shall not himself be taking part or contesting in the said elections. ( in case of absence of a consensus between the Managing Committee and the Area Welfare Officer about the appointment of a Returning Officer the matter will be referred to the Chief Welfare Officer, Department of Personnel & Training whose decision in this regard will be final )

Only regular member would be eligible for such appointment. No such person who held an executive post in the last Managing Committee will be eligible to be appointed as Returning Officer. The Area Welfare Officer will intimate the Chief Welfare Officer about the appointment of Returning Officer in time, giving his complete official and residential address and Telephone No. if any before the elections are notified.

(j) The committee shall have the right to accept or reject the resignation(s) of office bearers/members and to make appointment to fill vacancies caused either due to resignation or any other reasons, as under :-

(i) From amongst the elected Member of the Managing Committee to fill the vacancies of officer bearers.

(ii) From amongst the ‘regular’ members of the Association to fill the vacancies of Members of Managing Committee. The Managing Committee can fill the vacancies for the remaining part of the term thereof subject to the condition that the total vacancies ( to be filled) do not exceed or constitute 2/3rd of the total posts of the Managing Committee during the Block year.

A report on filling up of vacancies etc. shall be sent to Area Welfare Officer/ Chief Welfare Officer and required to be presented for ratification in the next meeting of the General Body which should be held within two months. The decision of the General Body shall be intimated to the Chief Welfare Officer, Department of Personnel & Training.

(k) All office-bearers shall function and act under the control of the Managing Committee. The Committee shall have the power to set up ad-hoc Committee or sub-Committee and to delegate powers to them as deemed necessary. The committee shall have the right to co-opt residents of the area (Regular or Associate Members) for such specific purpose or purposes, as it may deem fit.

(l) Any office-bearers/Member of the Managing Committee if directly/indirectly involved in political activity, may be removed from the Managing Committee by Chief Welfare Officer, Department of Personnel & Training, after he is satisfied about such act of the office bearer/member. The Chief Welfare Officer may also recommend to the Administrative Ministry/Department/Office of the concerned office bearer/Member for taking suitable disciplinary action under the CCS(Conduct) Rules, 1964.

(m) The Chief Welfare Officer, Department of Personnel & Training will also have power to dissolve a Managing Committee and set up an ad-hoc Committee to run the affairs of the Association or/and order mid-term election if :-

(i) On the basis of the reports he is satisfied that the work of the Association is not being conducted in accordance with the objectives laid down in the Constitution; or

(ii) Two thirds of the members (including office bearers) of the Managing Committee resign/leave office due to any other reason.

The mid term election for the remaining part of the term would be conducted by following the complete procedure of the election as laid down in this Constitution.

V. DUTIES, POWERS AND RESPONSIBILITIES OF OFFICE BEARERS OF THE COMMITTEE :

(a) individual office-bearer, who receive the grants-in-aid from the Departments of Personnel & Training (Welfare Section) shall be responsible for submission of the approved annual accounts etc. for the previous financial year to the Department of Personnel & Training

(b) PRESIDENT:

He shall preside over the meetings of the General Body/Managing Committee and exercise general supervision over the activities of the Association. He may dispose of such important and urgent matter which for want of time cannot be put up to the Managing Committee and report the same in the next meeting of the Managing committee. He may also authorise expenditure up to Rs.350/- expenditure so incurred should be got approved by the Managing Committee at its next meeting. He would be treated as ‘Head’ of the Association. In the event of resignation by any office bearer/member the President shall arrange to convene a meeting of the Managing Committee within a week of receipt of resignation in which Area Welfare Officer will also be invited.

(c) VICE-PRESIDENT

He shall carry out such duties as may be assigned to him from time to time by the President. In the absence of the President, he shall assume the duties and powers of the President.

(d) SECRETARY

He shall (i) maintain a register containing the names and addresses of the members of the Association, (ii) issue notice of the meetings in consultation with the President and record the minutes of the meetings, (iii) be responsible to the Managing Committee for all activities of the Association and will conduct correspondence on behalf of the Association, (iv) have authority to incur expenditure not exceeding Rs. 150/- in anticipation of formal sanction, such expenditure being reported to the Managing Committee for approval at its next meeting, (v) submit a report on the working of Association for the preceding year at the Annual General meeting and (vi) execute contracts on behalf of the Association as and when authorised to do so by the Managing Committee, (vii) keep all the records ( excluding cash and accounts) of the correspondence with him.

(e) JOINT SECRETARY

He shall carry out such duties as may be assigned to him from time to time by the President/Secretary. In the absence of the Secretary, he shall assume the duties and powers of the Secretary and shall be responsible to submit a quarterly report of activities to the Under Secretary ( Welfare), Department of Personnel & training and annual report and audited annual accounts within 60 days of the close of the financial year.

(f) TREASURER

He shall (i) be responsible for making all collections and receive cash and give receipts thereof on behalf of the Association and be responsible for the proper maintenance of Association Accounts, (ii) keep regular accounts of money received and disbursed and be responsible for the proper maintenance of the accounts book and other Registers of the Association and for this purpose, he shall post all the receipts of income & expenditure regularly in the Cash Book and put it up for information of the Managing Committee in its next meeting. (iii) work as Financial Adviser to the President/ Secretary of the Association, (iv) keep cash in hand up to Rs.100/- only and to deposit excess funds, if any, in the Bank (v) prepare an annual statement of accounts at the end of the financial year and after approval of the Managing Committee, submit it to the Annual General Body meeting, duly audited (along with the Auditor’s report and replies thereto, if any).

(g) CONVENOR

The Convenor shall look after the work relating to the filed of his assignment in consultation with President/Secretary

VI. AUDITOR

He shall be appointed by the Managing Committee before the end of March every year for audit of accounts of that financial year from amongst the regular members of the Association ( other than a sitting member of the Managing/ Executive Committee ). He shall audit the accounts of the Association and obtain clarifications in this regard, if necessary, from the office-bearers of the Managing Committee. He shall suitably endorse his report on the Annual statement of the accounts and on the list of assets of the Association etc.

VII. PATRON

The Area Welfare Officer, nominated for the area shall be the ex-officio patron of the Association. He shall be invited by the Association to attend all the meetings of the Managing Committee/General Body as a ‘Special Invitee’ where his role will be that of a ‘Passive Observer”. He will tender advice on matters raised in such meetings when called upon to do so and not interfere with the normal proceedings.

He shall be required to periodically review the Annual Action Plan of the Association and tender necessary advice to the Association on shortfalls, if any. Any special observation/Report on the Action Plan should be forwarded to the Chief Welfare Officer, Department of Personnel & Training.

It shall be duty of the Area Welfare Officer, as a Patron of the Association, to keep a special watch on enrolment or renewal of membership of the Association, particularly in the month of March every year. He shall ensure that every genuine allottee willing to become a member is enrolled as a member of the Association. In case of any difficulty faced by the residents, the Area Welfare Officer can entertain applications direct as provided in para II(g) above

VIII. GENERAL BODY

(a) The General Body shall consist of all members of the Association and the final authority of the Association shall vest in it.

(b) The rights and privileges of the General body shall be:-

(i) To elect the Managing Committee, including office-bearers and members latest by the end of April in every block of two years;

(ii) To remove any office-bearer/member of the Managing/Executive Committee/member of the Association

(iii) To adopt the Model Constitution, framed by the Department of Personnel & Training ( as amended from time to time) .

(iv) To pass the accounts of the previous year and consider the Auditor’s report and Annual report.

(v) To approve the programmes of activities of the Association for the ensuing year.

(vi) To consider and decide about the winding up of the Association and disposal of its assets and liabilities in consultation with the Department of Personnel & Training

(vii) To discuss any other item with then permission of the Chair.

A. ORDINARY MEETING OF THE GENERAL BODY

(1) The quorum for the General Body meeting shall be 1/4th of the total number of members on roll.

(2) A notice of at least 14 days shall be given in writing for convening an ordinary meeting of the General Body.

(3) A meeting for want of quorum may be adjourned by the President/Presiding Officer and no quorum shall be necessary for such an adjourned meeting when reconvened

(4) Meeting of the General Body of the Association shall be held at least once every year within a period of two months of the completion of the financial year i.e., before the 31st of May. Annual Report, Annual Accounts for the previous financial year and general plan/programmes for the next financial year would be approved/decided in these meetings.

(5) A special meeting of the General Body may be held either at the instance of the President of the Association or on a requisition signed by at least 1/5th of the total number of members to discuss specific matters to be stated in writing. The quorum for such meetings shall be at least 1/5th of the total .number of members on rolls of the Association present in person. In case, the Area Welfare Officer is satisfied about the need for calling a General Body meeting and if such meeting is delayed for any reason, he may with the approval of Chief Welfare Officer, Department of Personnel and Training advise the President to convene a general Body meeting for the purpose.

B.EXTRAORDINARY MEETING OF THE GENERAL BODY

(1) Matters pertaining to the removal of office-bearers including members and/or the removal of any members of the Association and appeals against the decisions of Managing Committee shall require 2/3rd majority of the members present and voting. The quorum for such meetings shall be 1/3rd of the total members on roll.

(2) A ‘NO CONFIDENCE MOTION’ against the Managing Committee shall be considered only if at least 1/3rd of the total members on roll put such a motion in writing and a meeting is convened specifically to consider it. The quorum for such General Body meetings shall be 1/3rd of the total members on roll and decision will be valid if the 2/3rd majority of the members present and voting in that meeting vote in favour of such a decision. In such a situation bye-election would be ordered with the approval of the Chief Welfare Officer, Department of Personnel & Training as per procedure of election laid down in the Constitution.

IX. ELECTIONS

(a) The list of Regular and Associate members as on 31st March should be displayed within a week from 1st April and finalised after 7 clear days of such display/notification by considering representation for rectification of errors, if any. In any case, the final voters list should be published latest by 15th April.

(b) All Office Bearers and Members of the Managing/Executive Committee shall be elected in the General Elections to be held by secret ballots. The date of elections, which should be on or before 30th April, shall be decided by the Managing Committee. The terms of the elected Office-Bearers and Members shall be TWO YEARS ( BLOCK OF TWO FINANCIAL YEARS). The Managing Committee shall cease to exist on the 1st May of the year when the elections are due or till the new Committee is declared elected whichever is earlier.

(c) Members (including Associate Members), whose subscription and other dues are not in arrears up to 31st of March of the year preceding the election year, shall be eligible to vote. Thus, only eligible residents who become member/associate member of the Association by 31st March of a year shall be eligible to vote and/or contest elections, as the case may be during the next financial year.

(d) Every member present and voting shall have one vote.

(e) Voting shall be by SECRET BALLOT.

(f) Elections shall be conducted by the Returning Officer who will be appointed in accordance with para IV(i). The Area Welfare Officer concerned would also act as ‘OBSERVER’ at that time. The Returning Officer would be given copies of voters’ list ( clearly indicating the voter number) on his appointment along with necessary material i.e., stationery/blank nomination forms/requisite Funds etc. for carrying out activities connected with the conducting of the elections. The Returning Officer would be given full assistance and co-operation by the Managing Committee/Members for smooth conduct of the elections. Nomination forms, duly proposed, seconded and accepted by the contestant member for a particular office, shall be received by the Returning Officer by a certain date and time fixed by the Managing Committee which should be at least 7 clear days before the date fixed for the meeting of the General Body/holding of the elections, as per the programme at Annexure-II. No person can hold more than one office at a time of two blocks and, therefore, will be eligible to contest only for one office.

(g) An elector shall be entitled to propose or second only one nomination paper. In case he/she has proposed one nomination paper and also seconded another nomination paper, in that case both the nominations would be invalid.

(h) No elector shall propose or second a nomination paper for an office for which he himself is a candidate. If an elector has already proposed or seconded a nomination paper for an office, his own subsequent nomination for such an office will be inoperative.

(i) All the members of the Association, who are eligible to vote in the elections to elect the office-bearers/Members of the Managing/Executive Committee, will be informed through wide publicity of the programme of election, as noted at (f) above, well in time in writing. While intimating them, they should be advised to bring their Identity Cards and allotment letters/electricity bills in their name and any other valid documents with them to substantiate the validity of their membership at the time the elections are held.

(j) In case of any dispute arising in the matter of Election process or Election Results, the Area Welfare Officer being an observer will submit a report to the Chief Welfare Officer in the Department of Personnel & Training for a decision, whose decision shall be binding upon the Association. Provided that after the declaration of the Election Results of an Association, if the Chief Welfare Officer is satisfied on the basis of the report of Area Welfare Officer/evidence brought to his notice that the elections have not been held in a fair manner or that mal-practices were resorted to by an individual(s), he may cancel the election and appoint an adhoc Committee of members and an independent Returning Officer in consultation with the Area Welfare Officer for holding fresh election. The adhoc body will discharge the functions of the Managing Committee till fresh elections are held.

(k) Persons aggrieved with the decision of the Chief Welfare Officer may appeal to the Joint Secretary in charge of the staff Welfare in the Ministry of Personnel, Public Grievances and Pensions for setting aside or revision or to modify the decision/decisions of the Chief Welfare Officer. The decision of such Joint Secretary shall bind all concerned finally and conclusively.

X. SOURCE OF INCOME

The source of income of the Association shall be :-

(i) subscriptions and fees as laid down in the Constitution and/or funds raised from time to time on specified counts.

(ii) Grants-in-aid from the Government.

(iii) Donations from Government(s) or Official Bodies.

NOTE: Chowkidar fund shall not be taken into consideration for any purpose by the Government.

XI.WITHDRAWALS FROM THE BANK

(i) these shall be authorised by the Joint signatures of the Treasurer and either the President or the Secretary.

(ii) The outgoing Managing Committee will not make any withdrawal from the Bank Account after the date of election.

XII. SUITS BY AND AGAINST THE ASSOCIATION

The Association may sue or be sued in the name of the President or the Secretary.

XIII. The Association shall not joint/federate with any other Association(s)/Federation(s) without the prior approval of the Department of Personnel & Training.

XIV. HANDING OVER OF CHARGE

The Secretary of the outgoing Managing Committee will be responsible for handing over the charge to the Secretary of newly elected Managing Committee within 15 days of the date on which results of the elections are declared by the Returning Officer. It shall be the duty of the Secretary of the outgoing Managing Committee to ensure that all documents, Registers relating to Accounts including Pass-Book, Cheque Book and other papers are handed over to the Treasurer of the newly elected Managing Committee whereas all other documents, Registers, appears and other assets/equipment/articles will be handed over to the Secretary of the newly elected Managing Committee. The Secretary of the newly elected Managing Committee shall inform the Area Welfare Officer about the position regarding handing over/taking over of the charge including matters relating to the Accounts within 7 days of the date on which charge has been/should have been handed over. If the post of the Secretary is vacant for any reason, another office-bearer, shall be nominated by the Managing Committee who shall be responsible for handing over the charge to the Secretary of the newly elected Managing Committee within 15 days of the declaration of the results. In case, the Secretary/Treasurer/Other Office-bearer nominated by the Managing Committee as mentioned above of the outgoing Managing Committee fails/refuses to hand over complete charge to the Secretary/Treasurer/Other Office-bearer of the newly elected Managing Committee within the due date, his conduct shall be viewed as ‘ Unbecoming of a Government Servant’ thereby, attracting provisions of the Central Civil Services (Conduct) Rules, 1964 and rendering him liable to appropriate disciplinary action. The Area Welfare Officer will send a report to the Chief Welfare Officer, Department of Personnel & Training in this regard within one month of the completion of election.

Such office bearers who fail/refuses to hand over the complete charge to the succeeding office bearers within a period of one month of the date of election, shall be debarred from holding the post of any office-bearer in any Resident Welfare Association.

XV.DISOLUTION

(a) Any number not less than 3/5th of the members of the Association may determine that it shall be dissolved, and thereupon it shall be dissolved forthwith, or at the time then agreed upon, and all necessary steps shall be taken for the disposal and settlement of the property of the Association, its claims and liabilities in consultation with the Department of personnel & Training.

(b) If upon the dissolution of the Association there shall remain, after the satisfaction of all the debts and liabilities and any property whatsoever, the same shall not be paid to or distributed among the members of the Association but shall be given to some other Association/Body/Authority to be determined by the Department of Personnel & Training.

XVI. INTERPRETATION

Any point relating to interpretation of the provisions of the Model Constitution or any other dispute pertaining to the functioning of the Association, relief on which has not been provided elsewhere in the Constitution, shall be referred to the Chief Welfare Officer, Department of Personnel & Training whose decision in this regard will be binding on all the parties.

        All we have to make efforts to collect due from all defaulters including Shiv Shankar. After all we would like that all residents live with harmony and maintain respect of each other.

        There is a management theory called 80/20 rule. In our context, it elaborates that 20 % people work hard to provide facilities to balance 80% people. Or in other words, 80% people enjoy on the hard work of 20% people. Now it is up to an individual, whether he wants to be in 80% or in 20%.

      Clarification is requested. A RWA not registered and convenes AGB without any agenda except Election for EC Members. Pressing aside the norms of election procedure – such as giving 21 days notice, appointing election officer, preparing elegible voters list, calling for nomination, srcutinisation,withdrawal, preparing ballet papper for secret election. Gathered a group of family members of about 50-subscribed and unsubscribed and elected 25 EC members out of the 50 gathered. when There is list of 115 Eligible members, is it proper to elect EC members without following any rules of association. They say, as this was an unregistered assocition basic norms need not be followed. Is this opinion right?

      When a association is unregistered and not following the basic principles, can other members for a group and register the association in the same name. kindly clarify

        If the society is not registered, the provisions under the SA 1860 will not be applicable. Since there are 115 desirous residents,the left over 65 residents being majority may form a RWA and apply for registration with the Registrar of Societies and can force the smaller group to fall in line. This has happened in our society also and now we have only one RWA.Once the society is registered, it will have to abide by the rules & regulation and can not be a family matter.

      Dear Vinesh

      Its a common feature that the office bearers of the RWA start their Property Business in the Society/ colony and then favour/ shelters their customers who indulge in unauthorised construction or encroachments.

      You may directly report/complaint to MCD at centralised phone no. 1266 with the office of Commissioner MCD and receive the complaint no.

      Once the complaint no is allotted the complaint can not be dropped irrespective of the influence of RWA.

      It may take time for MCD to take action in the matter. You can keep live the case by regularly asking MCD to inform you the status under RTI Act by submitting application along with fees of Rs. 10/- for each such request.

    If a flat is locked for 6 months and after 6 months that flat has a tenant , that tenant pays the monthly subscription to RWA for only balance 6 months.(i.e flat locked from January to June and tenant comes in July and pays for July to December).If elections of the EC are held every year ..DO A TENANT HAVE A VOTING RIGHT IN THE ABOVE MENTIONED SITUATION.

      Else file RTI, so that they can tell you which officer to be contacted….

      You should take a charge against such corrupt practice…

    My society is charging a maintenance charge of Rs 1500/- per month for self occupied and Rs 1650/- per month for rented flat. Now they have started charging additional Rs 5000/- per tenant in name of facility charges.
    Is it legal to charge differential maintenance charges from self occupied vs rented flats?
    Is charging of additional facility charges from tenants is legal?
    Can these provisions be challenged in consumer court?
    Please advise.

      All charges are payable strictly on voluntary basis and can be challenged in court if there is any compulsion to pay them.

    I am a resident of E Block, MIG flats in Sector 15 Rohini, New Delhi. We had formed RWA almost about 15 years back. We have 258 MIG flats but out of these 80 residents do not contribute to the RWA. We have made arrangements for the Chowkidars and other provisions such as instaling of Iron Gates around the flats etc. Kindly advice the rules so that all the residents can be made aware of the same and the contribution is taken from all of them.       Contribution to RWA is strictly voluntary. The reason is if payment is made compulsory then it shall violate the principle of liberty of man in the constitution and no law can go against the constitution.

    At my place RWA is made by people who don’t have any work and trying to make RWA as there political ground. They have put locks, gate and guards as per there own personal convenience rather for the convenience of society. I don’t think meeting are happening, effected people are not even consulted before making a any decision.

    I have been paying all the due charges to them, but now it has become frustrating when my 85 years old grandma has to walk extra 350 m when there is a gate just 10 Meters away from my home.

    What kind of legal action can be taken against them? How can I challenge the decision of a RWA, which are made with out any consideration? I had tried to talk things out, but it didn’t worked.

    Any Help, suggestions and comments are welcome.

    I am a resident of Sector-1 RK Puram and have been facing an issue for which I need some guidance.

    Some people in my locality drive their vehicle at a very high speed in the lane infront of the house. Their rash driving is a pain for us and they are never ready to understand that they should drive slow.
    Even after repetetive calls and requests they are not ready to understand that they should drive properly.

      As a resident it is your right to either become a member or refuse membership of the RWA. It is not compulsory. It is voluntary.

      RWAs benefits are few but headaches are more.

    The Residents’ welfare association of my apartment keeps coming up with new rules that differentiate based on whether one is a tenant or an owner. The latest one is that owners are allowed to park two cars inside while tenants are allowed only one. Everyone pays the same amount of charges for facilities and to me this appears vague. Today, its about parking slots, tomorrow, it could be about use of other facilities.

    So my question is:

    Is this a standard/common practices in other apartments?
    Also, is it normal to not allow tenants to be part of voting members of RWA?

    I am residing in govt. quarter at Vasant Kunj, New Delhi. There are several other PSUs having staff quarters in the same pocket. We have a Resident Welfare Society registered as Social Welfare Society with the Registrar of Societies, Kashmiri Gate, Delhi.Few private owner’s flat are also there in the pocket. It may be clarified whether there can be separate Registered society for the PSUs staff quarters and private owner. Further, if the private owners avoid becoming member of the common welfare society, can they enjoy security and other developmental facilities at the cost of contribution received from members of PSUs staff quarters.

    What action the RWA can take if the resident did not pay the subscription to the society. Whether RWA can stop illegal construction in the DDA flats (Lease hold). Our society has adopted a resolution by 17:6 votes in its GB meeting to prohibit illegal construction in the DDA flats of our pocket. Is this a correct step?

    Clarification is requested. A RWA not registered and convens an AGB without any agenda except Election for EC Members. Pressing aside the norms of election procedure – such as giving 21 days notice, appointing election officer, preparing elegible voters list, calling for nomination, scrutinisation,withdrawal, preparing ballet papper for secret election.
    Gathered a group of family members of about 50-subscribed and unsubscribed and elected 25 EC members out of the 50 gathered. when there is list of 115 Eligible members, is it proper to elect EC members without following any rules of association?

    They say, an unregistered assocition need not follow any basic norms. Is this opinion right?

    When a association is unregistered and not following the basic principles, can other members form a group and register the association in the same name? kindly clarify.

    Hello,
    A general election for governing body of our society held recently through secret ballot poll. The sitting President also contested the election and lost. Since he was occupying the post from the beginning due to poor attendance by the resident at the time of voting and mostly office bearers were being elected on voice vote, the President felt bad and started provoking residents against election process and frozen the society bank account as he being one of the signatory. However, Secretary and Treasurer has accepted the verdict and requested to the bank for change of signatory. But the bank has not accepted the resolution due to the request made by the defeated President in the capacity of Signatory. The new body finds difficulty in paying the wages to the wage earner enrolled in the society.
    Let me advice what action should be taken against ex President and how to get the bank account reopened.

    an association is a formation of the group for increase the strength of individuals. residents association is nothing different, a congregation of the people who stays in one place. Their objective is and should be the self-protection from every natural enemies. This has never reflected anywhere in the Law. The people of one place should meet and know one another is important so that intruders and strangers would never mislead individuals of the respective area. Every retrogression and every enemy of any person, family, country or the world is born inside by the contact from outside. Hence a residents association should give importance to this congregation, but never based on the wealth or position or other social status. Giving importance to the subscription in the form of coinage (money) and question on the income and expenditure is the main evil that detracts the individuals. Besides the coinage system, the growing transportation and communication facilities helps the offenders and enemies to escape quickly. Hence, these three evils are to be controlled, i.e., coinage subscriptions, highly accessible roads and increased communication facilities. It recalls the old proverb ” Even if nectar, more than limit would be the poison “. Those who has knowledge would understand the correct meaning and explanation of this since even our nation and our world is being polluted in the name of growth and development. So let our Residents Association to take initiative to limit these developments.

If the executive body of the resident welfare association does not follow the rules at all as approved by the registrar and not filing the annual audited accounts as well as income tax return inspite of collection of Rs.5 lakhs per year, what action can be taken against them.

      if you dont want to pay the subscription charges then you have to write to the association that you are cancelling your membership of the association for xyz reason and therefore will not be paying the charges in future. All charges till the date of writing this letter must be paid.

    am a resident of DDA MIG FLATS, Prasad Nagar phase 2, i had purchased
    this flat in 2002 and since then my dues are clear, but dues of the
    previous owner are still outstanding from 1983-2001 approx INR 3750/-
    which i refuse to pay. My argument with the association is that , the
    previous committee should have collected their dues. Now there are
    Election of the office bearers in the association, they say that I am
    not eligible to contest. Since the arrears are not clear. Please advice.

    Dear Sir,
    Our Resident Welfare Association is registered body under the Registrar of Societies Act 1860. In the year 2007 the then management committee suddenly without amending the constitution as per the laid procedures in Registrar of Societies Act 1860. Section 12, and without follwoing the rules clearly stipulated in our RWA constitution, reduced the number of members and election was declared. Inspite of our objections to Returning Officer (which was supposed to be appointed by General Body, but illegally choosen by management committee) in writing, the election was held unconstitutionaly. Secondly, on our written complaint to Registrar and request to interven, the Registrar on feb 2008 confirmed that no amendments have been made in the constitution with regard to reduce the number of elected representative and advised us to go to civil court of the jurisdiction the area comes under. Thus, we stopped paying them, but never filed the court case. Resultantly, RWA threaten us with legal action. Later on in the year 2008, they declared us Non-Member of RWA. In the year 2011, RWA issued notice to us for clearing the outstanding dues as subscription for last four years. We, in reply to their notice, we asked then for amended copy of valid constitution and then only we start paying subscription. Now, they have filed a Civil Suit for recovery of maintenance charges.
    Kindly advise,
    1) whether I can also file the civil suit agianst the RWA to be delcared as an illegal RWA?
    2) Also, pls let us know under which rule or act of Consitution, they can not force us to become the member of RWA.

    can you guide me when a RWA society can ask tenant to vacate the premises
    We have been leaving in a hosuing society for last 4 yrs in same flat and suddenly we receive unilateral notice from president to vacate the flat within 15 days w/out any information to our landlords.
    the basis of notice was that we were conducting yoga classes (commercial) activity in the flat (only for children that to on request of society members)
    But same was well known to everyone and no such prior notice was given.
    Understand yoga should fall under medical practice as same is helping one to improve on ones health.
    All our dues to society are always been cleared in time, then do RWA still reserve right to take such unilateral action w/out even informing our landlord.

    Sir,

    My apartment complex has 1150 plus apartments out of which about 570 apartments have already been handed over i.e. possession has been given. Rest of the apartments are either in finishing stages or still in construction stage. Some of them are yet not sold by the builder.

    Out of the 570 apartments already handed over, about 320 apartments are inhabited. More than 80% of inhabited apartments have tenants living there. Remaining 60-70 apartments have the owners themselves residing here.

    About 25-30 of these resident owners have established a core group and they are in process of forming a RWA claiming to be representatives of the whole 320 inhabited apartments.

    Can they form a RWA this way. Will it be democratic and legal? Will it amount to hijacking of the RWA formation process by a few. The builder runs the maintenance in the complex.

    Any advice will be appreciated.

      We were complaining our RWA in verbal communication for water supply problem & deployment of Security guard when the gate near to our opens (Usually RWA president keeps the security guard near to his house only). They were just letting it go for past one year & then we stopped paying the monthly charges with verbal intimation. Now it is been six months we stopped it. Now we have received a notice from them, stating that they will take a legal action.
      Also in the notice it is mentioned that they have installed the gates for our colony security & without information of any charges imposed on us, stating that they have mentioned it in core committee meeting, then how come we can know about that.
      Am I compelled to continue my membership or I can leave it.

    Sir, I am a resident of Mayur Vihar Phase-1, Pocket-5. Here RWA members have closed two gates of colony’s Central Park without consulting any of the colony residents. It has caused problems for both the children (who hop gates & often injure themselves ) & the residents who have to walk extra, to reach in the park. When we residents went to the RWA members to talk about the issue they misbehaved us & said that MCD has given the ruling to close the multiple gates of Park & they would’t open them even if the residents want those gate to be opened.

    What kind of legal action can be taken against them? has MCD given any such ruling? How can I challenge the decision of a RWA, which are made with out any consideration? I had tried to talk things out, but it didn’t work.

      As per my knowledge, there is no provision under any Act under which formation of Association/RWA by the resident is complusary for an Society/Flat Owners etc.Accordingly, since formation of Association/RWA is not mandatory,how to become member of the Association/RWA can be complusary.RWA is a volunter body which is managed by volunteers without any fee etc.There are following three type of services available to the residents
      1.Services provided by the local bodies such as roads,park,street lights etc.by the MCD/DDA.RWAs can make efforts to improve quality of these services but cannot decide to stop to non members to avail these services.
      2.Services provided by the Associations/RWAs such as welfare activities such as cultural prog. deposit of bills etc. and these facilities can be restricted to members only.
      3.These services are paid services such as Supply of Electricity/water,Cleaning of cars,Drycleaning of cloths etc. and Association/RWAs can not stop non members not to avail these services.
      I furthe feel that in case Association/RWAs members try to threten to stop paid services or services provided by Local Bodies, will be deemed to be infringment of fundamental rights and legal action/FIR can be called/lodged against members intrfering for the same.
      Kindly communicate whether my views are on the right path to share/perculate futher.

        In case of newly constructed DDA flats, it is mandatory for all flat owners to become members of RWA, ( You may see brochure of your flats, if applicable there). But ,generally formation of RWA activity comes later after people start communicating with each other and feel necessity of formation of RWA. Again only a small fraction of people take this lead.
        The interesting fact about RWA is that people, in general, avoid participating in meetings organized by RWA but expect too much from them. As stated in various communication here that RWA is a voluntary organisation, the best way to get its output is to volunteer yourself for the social cause, take part in the developmental activities and then comment.
        But now, Delhi govt. has a mediation center where counselling is done by experienced team members for small disputes. You can refer the matter there & hopefully result will be positive.

        Dear Sir,
        We were complaining our RWA in verbal communication for water supply problem & deployment of Security guard when the gate near to our opens (Usually RWA president keeps the security guard near to his house only). They were just letting it go for past one year & then we stopped paying the monthly charges with verbal intimation. Now it is been six months we stopped it. Now we have received a notice from them, stating that they will take a legal action.
        Also in the notice it is mentioned that they have installed the gates for our colony security & without information of any charges imposed on us, stating that they have mentioned it in core committee meeting, then how come we can know about that.
        Am I compelled to continue my membership or I can leave it.

    Sir. I wish to understand a few things w.r.t functioning of RWAs in New Delhi.
    1. Can RWAs penalise members who have/are defaulting in payment of Annual Society / Membership Charges and/or initiate legal action against them for no-payment of dues / outsstanding arrears? Are these implementable under provisions of any law? If so, may kindly advise?
    2. Do provisions of The Delhi Apartment Owners Act 1986 apply to all RWAs in New Delhi? Under this law is it mandatory for RWAs to issue Share Certificates to all members?
    3. The model constitution suggested does not mention the above powers / fucntions of the RWA.
    4. Do RWAs have the right to restrict access / entry for non-residents or is it mandatory for them to provide right of way since roads within most pockets are maintained by MCD?
    5. Is it mandatory for the RWA to hold AGMs 3 times a year? Kindly suggest / advice.

    Do you have any Information/Court ruling in the following context –

    Authority that can enforce rules and regulations framed by general body of a registered DDA flat owners RWA: If such an RWA wants to enforce its rules and regulations and some adamant resident continues to act against social sense despite RWA advise and pressure, followed thereafter by advise from Police (senior level), what enforcement course or route is available to the RWA. Police excuses itself saying that it can only TRY to suggest sense but since the case is of civil nature and not criminal (or has not taken a criminal turn YET) it is beyond enforcement by Delhi Police.

    Before going to the court, is there any other authority that resolves civil disputes falling under RWA rules and regulations ?

    What are the government guidelines? Any answers that can help DDA flat owners RWAs?

    Are tenants liable to pay more maintenance charges compared with residents in Delhi Dwarka. Even though they have surplus amount of money.
    N this left over surplus money is collected from all keeping the difference of aprx 65/35 with tenants. Then how tenants r benifited after living the house or society. N the money is not refundable.
    Pl suggest n guide for better clarity or anything going wrong here with tenants.

    My name is Himanshu Bisht and i am a resident of A-block pocket-3 Bindapur DDA flats, Dwarka 110059. I have been living at this place for more than 4 years. The A-Block formed RWA members are not doing anything. They come up with something all of a sudden then enforce it on others even without knowing whether the people living in the block are ok or not. I live in Flat No-6. There was a gate which was formed after collecting money for the safety of the flats in the street where i live and after that after few years there recently the rwa of the block made sure that there are places where in the gates are in place for safety of the society. My problem starts here. I work different shifts including night shifts and i am asking them to give me the keys of the nearby gate to me so that i can go out whenever its a night shift as there is no watchman and watchman will be there only on one gate as decided by them. They have denied me of the keys. I have not received any keys which i was promissed infact everyone was promissed earlier. I even doubt whether the entire money which everyone paid for the gates was utilized for the purpose it was paid for or not. Please do an audit or take care of my concern. I am not ok with this. I bought the house where i live and i live there and they donot have any right to decide and do whatever they want to do. If i will be facing problems because of that why should i accept it. Safety and security is ok but there is a way to implement things. Some of them donot even know how to talk. They are members and secretary and then also they donot do there work properly and i donot understand how can someone who is working full time whether a government employee or a private employee be a secretary or a member of a particular block rwa as he or she cannot spend that much time taking care of all the issues as compared to someone who is a retired employee or may be an educated women who is not working and is a housewife. Wow, please take into consideration few things which i said and try and take strict action.

That person would take a round of his own place and then go to hospital rathing going the straight way and saving time. I would need an answer and action to be taken as soon as possible. Otherwise i have to do something else. Because i am not someone who will be sit down and wait for a response for long.     Does RWA have the rights to change the clauses of Sale Deed from the builder? In the Sale Deed the builder commits to give the membership of the club free. Later he charges for the same. The RWA negotiates for the subscription but does not fight for the said clause in the sale deed. This clause is universal for all owners numbering around 500.

Earlier I didn’t know is there any RWA exists in this society but later I see a letter to RWA pocket 10B Jasola. But, I don’t know who are the members and where is the office.
    My question is, is there any problem to run a parlor in our free hold flat? what are they? Can I put hoarding outside the flat and on the entrance of DDA? Is there any permission require from RWA”

    I am from sector 61 Noida. The RWA of the sector is defunct and has been occupied by property dealers .Same people are continuing on the positions and when election formalities are fulfilled no one was aware.I understand that there should be proper notifications for everything but everything is done on the sly. Most of the office bearers are from the same family and have political affiliations with ruling party of UP.

Most residents are busy in their work / offices and find little time to intervene. Given this scenario, RWA has started making structural changes in the society (in public / common space) such as a new gate for the society, changes in individual buildings etc. None of these are based on consent of the residents but through nexus of management of RWA. They are using these projects to exhort more money from residents as well as siphon off money through civil and maintenance work. Unfortunately most residents are silent and paying instead of acting against these corrupt practices, which only motivates the RWA management to be bolder their corrupt work.

Can any RWA that out-lives its tenure, be extended in RWA office indefinitely ? , Do general RWA members have right to get Elections conducted on own or under supervision of administering authority notwithstanding any claims by office holding RWA team. What legal rights and authority does office holding RWA has to challenge such conducted Elections ?
    2. Can a RWA President/other OBs continue in office even 6 months after their tenure ends ?
    Can resident members of a society RWA, dissolve a standing RWA team and its Office Bearers if RWA team and its members do not vacate office on their own, after end of their term ?

    3. Can RWA/President/Gen Secy who call and organise GBM or Special Meeting, nullify same on grounds of `insufficient quorum` whether or not any decisions taken. Are they within their legal rights to do so, particularly when they themselves have invited the meeting ?

    4. Who appoints Election RO – RWA, President, GBM and general members ?

    5. Is any Appointment Letter required to be issued to Elections RO chosen by residents in a GBM ? Moreso, if Person appointed as Election RO gives Acceptance and confirms in GBM itself ?

    6. Can different groups of residents form parallel RWAs within same society ?

    7. Is it true that RWA team and OBs including President & Gen Secy stand dissolved with declaration of Elections and appointment of RO ? Can they issue notices or conduct or hold GBMs or Special meetings ?. Who is authorized to call `Emergency Meeting` under necessary circumstances, after declaration and commencement of Elections ?

    8. What all support Election RO can demand from existing RWA/President as within his constitutional rights ?

    9. What action can Election RO take against any member or RWA office bearer, who tries or attempts to delay, or de-rail or sabotage the Election process or fails in his her duties to support and assist Election RO as against his lawful duties ? Can Election RO can debarr any such dissolved RWA office bearer who is causing obstacles in Election process ?

    10. Can major decisions on new work, projects or contracts to vendors be taken by dissolved RWA during Election phase ?

    11. If dissolved RWA or it core Office bearer team fails to carry on or deliberately avoids to carry on administrative and facilities maintenance work, what action can Election RO take in order to regulate and control normal functioning of society till new RWA team takes charge handover ?

    Can a registered association can issue a ” MEMBERSHIP INCLUDING FORM ” asking the Members Details like there name n adress and basic details..

    Can the same association can ask the details of the MEMBERS

    a) Ration Card details ( for adress proof )

    b) ADHAR Card details ( For I D Proof )

    c) VOTER ID Details ( For I D Proof )

    If these informations are asked in Membership form is that

    AN OFFENSE

    AN ILLEGAL ACTIVITY

    or AGAINST LAW

    If it is not ILLEGAL CAN ANY ONE HELP ME ON THIS REGARD…

      Whether it is a condition in the apartment rules or any other rules that more than 50 percent of physically occupancy is mandatory cum necessary in order to form a WELFARE RESIDENTS ASSOCIATION as in our case there are roughly 138 units(flats) and as such 130 have cleared their payments and have been offered possession letters whereas only 30 families have started living in the society. Now are they eligible from day one to form WELFARE RESIDENTS ASSOCIATION or they have to wait for 50 per cent of the occupancy and till then the developers have formed his maintenance agency which has started collecting monthly maintenance charges which includes krishi kalyan tax, swachh abhiyaan tax.

    General election notification (AOA, UP) was given and the nominations closing date was also over. There is only one contestant for each post and can say it was unanimous election. Now we need to declare the results and move further procedure like result declaration, certificate of winning (if the procedure is there), oath ceremony, handover and intimation to Registrar (Meerut) and to to builder etc. Can some body please guide in detail is there any formats for declaration, certificate of winning (if the procedure is available), handover, intimation to the authorities (Ghaziabad/Meerut) etc. or let me know what to write exactly.

    The constitution of RWA in DDA society should be done through election (secret ballot) as per the laws. The DDA society at Dwarka sector 18B was ready for occupation in 2013 and a RWA was registered in 2013 with some of occupants without election. This society was not able to maintain the norms and subsequently it was taken over by a new RWA without election (secret ballot). Recently RWA conducted Annual General body meeting was conducted where most of the member present asked and raised concern over election and a new RWA due to mismanagement and other security issues, however the meeting was closed and General Secretary announced that there will be no election.
    What members should do?

    Kindly revert, can RWA members issue ‘show cause notice’ to EC body (president) in case EC doesn’t follow bye-laws and practicise un-constitutional practices, such as spending is more than approved budget, spending without approval of even EC members, accounts are not made public, etc. etc.

      not on public road which are under MCD or PWD or any other govt body. But RWA can place private guards,barriers and gate of the area within the colony.

Whether this association has rights to decide & move ahead to do the structure modification to club house with the google opinion poll( total owners 321, poll attend by 162, agree for changes by 140 owners and disagree by 22 owners), they call it is democratic way.     लक्‍सर जिला हरिद्वार क्षेत्र मे लगे टावरो को हटवाना चाहाते है क्‍या ये टावरोे को हटया जा सकाता है अगर है तो इसके लिए क्‍या करना पडेगा हमेारे क्षेत्र लक्‍सर मे पहले 1 या 2 टावर थ परन्‍तु अव इनकी संख्‍या बढाकर 14-15 कर दी गयी है क्‍या इन टावरो को हटाने के लिए क्‍या करेा ।
